These terms and conditions outline the rules and regulations for the use of Wheels On Lease's website and services. By accessing this website, we assume you accept these terms and conditions in full. Service Provider Disclaimer
1. Service Nature: Wheels On Lease is an online platform that connects vehicle
owners with individuals seeking to rent vehicles. We do not own, operate, or control any vehicles listed on our platform.
2. Ownership and Responsibility: All vehicles listed on our platform are the property of their respective owners. Wheels On Lease does not hold any legal rights over the vehicles. The vehicle owner, as registered with the Regional Transport Office (RTO), is solely responsible for the vehicle's maintenance, insurance, and compliance with all applicable laws and regulations.
3. Platform Role: Wheels On Lease is only a service provider that connects Lessors (vehicle owners) to Lessees (renters). We do not take any responsibility for the vehicles or the rental transactions.
Vehicle Rental Terms
1. Eligibility to Rent: To rent a vehicle through Wheels On Lease, you must possess a valid driving license and meet all legal requirements for driving in India. Lessees should be well-experienced drivers or riders with more than one year of a valid license.
2. Documentation: Renters must provide valid identification, proof of address, and a valid driving license at the time of rental. These documents must be presented to the vehicle owner for verification. Lessees must also show and share all their legal documents through the DigiLocker application, a digitization service provided by the Indian Ministry of Electronics and Information Technology under its Digital India initiative.
3. Rental Agreement: A separate rental agreement between the vehicle owner and the renter will govern the terms of each rental. Wheels On Lease is not a party to these agreements.
Legal Compliance
1. Vehicle Registration and Insurance: All vehicles listed on our platform must be legally registered with the RTO and must have valid fully covered insurance coverage and a pollution certificate as required by Indian law.
2. Safety and Roadworthiness: Vehicle owners must ensure that their vehicles are safe and roadworthy, complying with all applicable safety and maintenance standards. Vehicle owners must also have the latest GPS tracking devices with a Kill Switch installed in their vehicles.
3. Driver's Responsibility: Renters must adhere to all traffic laws and regulations while operating the rented vehicle. Any fines, penalties, or legal issues arising from the misuse of the vehicle are the sole responsibility of the renter.
4. Travel Insurance: Wheels On Lease recommends that Lessees have valid domestic travel insurance to cover all potential insecurities during the rental period.
Liability and Indemnity
1. Platform Liability: Wheels On Lease is not liable for any damages, injuries, or
losses arising from the use of the rented vehicles. Any disputes between vehicle owners and renters must be resolved directly between the parties involved.
2. Indemnity: Users agree to indemnify and hold Wheels On Lease harmless from any claims, losses, or damages arising from their use of the platform or the rented vehicles.
User Conduct
1. Prohibited Activities: Users are prohibited from using the platform for any illegal activities or to engage in fraudulent behavior.
2. Account Security: Users are responsible for maintaining the confidentiality of their
account information and are liable for all activities conducted under their accounts.
Modifications to Terms
Wheels On Lease reserves the right to modify these terms and conditions at any time. Users are encouraged to review the terms periodically. Continued use of the platform constitutes acceptance of any changes made to these terms.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Dehradun, India.
